Welcome to Orbion, a predictive platform provided by Orbion GmbH ("Orbion," "we," "us," or "our"). By accessing or using our platform (the "Platform"), you ("user," "you," or "your") agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these Terms, you must not use our Platform.
Access to the Platform
Orbion grants you a limited, non-exclusive, non-transferable license to access and use the Platform solely for your internal business purposes in accordance with these Terms.
User Accounts
To access certain features, you must create an account. You agree to:
Provide accurate, current, and complete information during registration.
Maintain and promptly update account information as necessary.
Secure your account credentials and immediately notify us of any unauthorized use.
Orbion reserves the right to suspend or terminate accounts that violate these Terms or compromise platform security.
Platform Usage
You agree not to:
Attempt unauthorized access or disrupt Platform operations.
Use the Platform to violate applicable laws or regulations.
Engage in data mining, scraping, or similar data gathering activities without express permission.
User Content
You retain ownership of any protein sequences and related data ("User Content") that you input into the Platform. By submitting User Content, you grant Orbion a non-exclusive, royalty-free, worldwide license to use, process, analyze, store, and display such content solely to provide and enhance our Platform services. Orbion will not claim ownership over your User Content.
You represent and warrant that you have the rights necessary to grant the above license for your User Content.
Intellectual Property
All content, including software, models, algorithms, text, graphics, images, and designs provided on the Platform, except for User Content, is the intellectual property of Orbion or its licensors. Unauthorized use is strictly prohibited.
Payment and Subscriptions
Orbion operates on a subscription model. Payment terms are provided at the time of purchase. Failure to pay subscription fees may result in suspension or termination of your access.
Disclaimer
The Platform and all related services are provided "as is" without warranties of any kind, either express or implied. Orbion does not guarantee accuracy, completeness, or usefulness of any information provided.
Limitation of Liability
In no event shall Orbion, its affiliates, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
Indemnification
You agree to indemnify, defend, and hold harmless Orbion, its officers, employees, affiliates, and licensors from and against all losses, damages, liabilities, and expenses arising from your violation of these Terms or misuse of the Platform.
Termination
Orbion may suspend or terminate your access to the Platform without prior notice if you breach any provision of these Terms. Upon termination, your right to use the Platform immediately ceases.
Changes to These Terms
Orbion reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform, and your continued use constitutes acceptance of those changes.
Governing Law
These Terms are governed by the laws of Germany. Disputes arising from these Terms will be resolved exclusively in the courts of Berlin, Germany.
